?Libya said on Wednesday it will ask the UN?Security Council to lift an embargo on arms imports to the instability-wracked?North African country.

?At my meeting next week with the UN Security Council president, I will?discuss the question of lifting the embargo,? said Prime Minister Ali Zeidan,?quoted by the official news agency LANA.

?The issue will be discussed in all its aspects,? he said after a meeting?on efforts to rebuild the Libyan armed forces attended by Defence Minister?Mohammed al-Barghati, chief of staff Yussef al-Manghush and several officers.??The Security Council imposed the embargo at the start of the 2011 uprising?which led to the downfall of Moamer Kadhafi?s regime to protect the civilian?population from his forces.

But Libya has since been increasingly insecure and the authorities are?struggling to form a new army as militias control large swathes of territory.? In mid-December, the authorities decided to seal off Libya?s long and?porous borders with Algeria, Niger, Sudan and Chad, declaring the south of the?country a closed military zone.

Laser mastery narrows down sources of superconductivity

Feb. 24, 2013 ? Identifying the mysterious mechanism underlying high-temperature superconductivity (HTS) remains one of the most important and tantalizing puzzles in physics. This remarkable phenomenon allows electric current to pass with perfect efficiency through materials chilled to subzero temperatures, and it may play an essential role in revolutionizing the entire electricity chain, from generation to transmission and grid-scale storage. Pinning down one of the possible explanations for HTS -- fleeting fluctuations called charge-density waves (CDWs) -- could help solve the mystery and pave the way for rapid technological advances.

Now, researchers at the Massachusetts Institute of Technology and the U.S. Department of Energy's Brookhaven National Laboratory have combined two state-of-the-art experimental techniques to study those electron waves with unprecedented precision in two-dimensional, custom-grown materials. The surprising results, published online February 24, 2013, in the journal Nature Materials, reveal that CDWs cannot be the root cause of the unparalleled power conveyance in HTS materials. In fact, CDW formation is an independent and likely competing instability.

"It has been difficult to determine whether or not dynamic or fluctuating CDWs even exist in HTS materials, much less identify their role," said Brookhaven Lab physicist and study coauthor Ivan Bozovic. "Do they compete with the HTS state, or are they perhaps the very essence of the phenomenon? That question has now been answered by targeted experimentation."

Custom-grown Superconductors

Electricity travels imperfectly through traditional metallic conductors, losing energy as heat due to a kind of atomic-scale friction. Impurities in these materials also cause electrons to scatter and stumble, but superconductors can overcome this hurdle -- assuming the synthesis process is precise.

For this experiment, Bozovic used a custom-built molecular beam epitaxy system at Brookhaven Lab to grow thin films of LaSrCuO, an HTS cuprate (copper-oxide) compound. The metallic cuprates, assembled one atomic layer at a time, are separated by insulating planes of lanthanum and strontium oxides, resulting in what's called a quasi-two-dimensional conductor. When cooled down to a low enough temperature -- less than 100 degrees Kelvin -- strange electron waves began to ripple through that 2D matrix. At even lower temperatures, these films became superconducting.

Electron Sea

"In quasi-two-dimensional metals, low temperatures frequently bring about interesting collective states called charge-density waves," Bozovic said. "They resemble waves rolling across the surface of a lake under a breeze, except that instead of water, here we actually have a sea of mobile electrons."

Once a CDW forms, the electron density loses uniformity as the ripples rise and fall. These waves can be described by familiar parameters: amplitude (height of the waves), wavelength (distance between waves), and phase (the wave's position on the material). Detecting CDWs typically requires high-intensity x-rays, such as those provided by synchrotron light sources like Brookhaven's NSLS and, soon, NSLS-II. And even then, the technique only works if the waves are essentially frozen upon formation. However, if CDWs actually fluctuate rapidly, they may escape detection by x-ray diffraction, which typically requires a long exposure time that blurs fast motion.

Measuring Rolling Waves

To catch CDWs in action, a research group at MIT led by physicist Nuh Gedik used an advanced ultrafast spectroscopy technique. Intense laser pulses called "pumps" cause excitations in the superconducting films, which are then probed by measuring the film reflectance with a second light pulse -- this is called a pump-probe process. The second pulse is delayed by precise time intervals, and the series of measurements allow the lifetime of the excitation to be determined.

In a more sophisticated variant of the technique, largely pioneered by Gedik, the standard single pump beam is replaced by two beams hitting the surface from different sides simultaneously. This generates a standing wave of controlled wavelength in the film, but it disappears rapidly as the electrons relax back into their original state.

This technique was applied to the atomically perfect LaSrCuO films synthesized at Brookhaven Lab. In films with a critical temperature of 26 degrees Kelvin (the threshold beyond which the superconductivity breaks down), the researchers discovered two new short-lived excitations -- both caused by fluctuating CDWs.

Gedik's technique even allowed the researchers to record the lifetime of CDW fluctuations -- just 2 picoseconds (a millionth of a millionth of a second) under the coldest conditions and becoming briefer as the temperatures rose. These waves then vanished entirely at about 100 Kelvin, actually surviving at much higher temperatures than superconductivity.

Ruling out a Suspect

The researchers then hunted for those same signatures in cuprate films with slightly different chemical compositions and a greater density of mobile electrons. The results were both unexpected and significant for the future of HTS research.

"Interestingly, the superconducting sample with the highest critical temperature, about 39 Kelvin, showed no CDW signatures at all," Gedik said.

The consistent emergence of CDWs would have bolstered the conjecture that they play an essential role in high-temperature superconductivity. Instead, the new technique's successful detection of such electron waves in one sample but not in another (with even higher critical temperature) indicates that another mechanism must be driving the emergence of HTS.

"Results like this bring us closer to understanding the mystery of HTS, considered by many to be one of the greatest problems in physics today," Bozovic said. "The source of this extraordinary phenomenon is slowly but surely running out of places to hide."

(AP) ? Swedish furniture giant Ikea became entangled in Europe's widening meat scandal Monday, forced to withdraw meatballs from stores across Europe amid suspicions that they contained horse meat.

Stores in the U.S. and Canada were not affected, Ikea said.

The company reacted after authorities in the Czech Republic said they had detected horse DNA in tests of 1-kilogram (2.2-pound) packs of frozen meatballs that were labeled as beef and pork. The Czech State Veterinary Administration said it tested two batches of Ikea meatballs and only one of them contained horse meat. It did not say how much.

Meatballs from the same batch had been sent from a Swedish supplier to 12 other European countries ? Slovakia, Hungary, France, Britain, Portugal, the Netherlands, Belgium, Spain, Italy, Greece, Cyprus and Ireland ? and would be pulled off the shelves in all of them, Ikea said.

Later Monday, the company expanded the withdrawals to stores in 21 European countries and in Hong Kong, Thailand and the Dominican Republic, all of which were getting meatballs from the same Swedish supplier.

Ikea spokeswoman Ylva Magnusson said that included most European countries, but not Russia and Norway, which use local suppliers. Stores in Poland and Switzerland use both local suppliers and the Swedish one, but would now only use locally produced meatballs, she said.

"This is an extraordinary effort to ensure that no one is worried," Magnusson told The Associated Press.

She added that two weeks ago Ikea tested a range of frozen food products, including meatballs, and found no traces of horse meat. The company plans to conduct its own tests to "validate" the Czech results, she said.

Ikea's North America branch said the U.S. stores get their meatballs from a U.S. supplier.

"Based on the results of our mapping, we can confirm that the contents of the meatballs follow the Ikea recipe and contain only beef and pork from animals raised in the U.S. and Canada," Ikea North America spokeswoman Mona Astra Liss said in a statement.

Ikea is known for its assemble-it-yourself furniture but its trademark blue-and-yellow megastores also have cafeteria-style restaurants offering Swedish dishes such as meatballs served with boiled or mashed potatoes, gravy and lingonberry jam.

European Union officials met Monday to discuss tougher food labeling rules after the discovery of horse meat in a wide range of frozen supermarket meals that were supposed to contain beef or pork. So far those foods include meatballs, burgers, kebabs, lasagna, pizza, tortelloni, ravioli, empanadas and meat pies, among other items.

Authorities say the scandal is a case of fraudulent labeling but does not pose a health risk.

Gunnar Dafgard AB, a family-owned frozen foods company in southwestern Sweden that supplies Ikea's meatballs in Europe, posted a brief statement on its website saying "the batch in question has been blocked and we are investigating the situation."

Spokesman Ola Larsson said the company was conducting its own DNA tests and wouldn't comment further until it has those results.

Sweden's food safety authority said it wasn't taking any action but was waiting for Czech authorities to specify the quantity of horsemeat detected.

"If it's less than 1 percent it could mean that they handled horsemeat at the same facility. If it's more, we assess that it's been mixed into the product," said Karin Cerenius of Sweden's National Food Agency.

The Czech authority said a total of 760 kilograms (1,675 pounds) of the meatballs were stopped from reaching the shelves. It also said it found horse meat in beef burgers imported from Poland during random tests of food products.

"Unfortunately, the testing method we use detects just the quality ... the presence or non-presence of horse DNA," said Jan Vana, a senior official at the State Veterinary Administration. "At the moment, we can't say the quantity of it."

Spanish authorities, meanwhile, announced that traces of horse meat were found in a beef cannelloni product by one of the brands of Nestle, a Switzerland-based food giant.

In a statement on its website, Nestle Spain said it was withdrawing six "La Cocinera" products and one "Buitoni" product from store shelves. It said it was taking the action after traces of horse meat were found in beef bought from a supplier in Spain and that it was taking legal action against the company.

Processed food products ? a business segment with traditionally low margins that often leads producers to hunt for the cheapest suppliers ? often contain ingredients from multiple suppliers in different countries, who themselves at times subcontract production to others, making it hard to monitor every link in the production chain.

Standardized DNA checks with meat suppliers or more stringent labeling rules on disclosing the origin of processed food's ingredients will add costs that producers will most likely hand over to consumers, making food more expensive.

The scandal has created a split in the European Union between nations like Britain, which see further rules as a protectionist hindrance of free trade under the 27-nation bloc's single market, and those calling for tougher regulation, including Austria and Germany.

"Consumers have every right to the greatest-possible transparency," German Agriculture Minister Ilse Aigner said.

At the meeting in Brussels, several EU agriculture ministers called upon the Commission, the bloc's executive arm, to speed up presenting a proposal on tougher regulation by this summer.

The scandal began in Ireland in mid-January when the country announced the results of its first-ever DNA tests on beef products. It tested frozen beef burgers taken from store shelves and found that more than a third of brands at five supermarkets contained at least a trace of horse. The sample of one brand sold by the British supermarket kingpin Tesco had more than 25 percent horse meat.

Microsoft Says It Suffered Same Hack Attack as Apple, Facebook

Add Microsoft to the list of companies experiencing hacker attacks.

The company said in a blog post on Friday afternoon that it suffered the same security breach that Facebook and Apple have recently been dealing with.?

Malware-infected websites contaminated some of Microsoft's computers, it said, adding that no customer data was compromised. Microsoft did not say when they discovered the breach.

"During our investigation, we found a small number of computers, including some in our Mac business unit, that were infected by malicious software using techniques similar to those documented by other organizations," Matt Thomlinson, the general manager of Microsoft's security unit, said in the post.

The tech giant said it refrained from making a public statement during its initial investigation.

"This type of cyber attack is no surprise to Microsoft and other companies that must grapple with determined and persistent adversaries," Thomlinson said, adding that the company will "re-evaluate" its security strategy.

Earlier this month Twitter said 250,000 accounts were compromised when its system was breached. Then, Facebook said last Friday that it was the victim of a "sophisticated attack."

A New York Times report in January detailing apparent Chinese hackers infiltrating its internal systems prompted a sudden uptick in hacking, or at least in companies admitting to being hacked.

NBC.com was hacked in a malware attack on Thursday, potentially infecting any viewers that clicked over to the network's site.

On Tuesday, Apple said its systems were hacked, but no user data was compromised.

And earlier on Friday, a cyber attack on the customer support service Zendesk left Twitter, Tumblr and Pinterest scrambling to alert users whose email addresses were stolen.

US stocks keep sliding on weak data, Fed qualms

U.S. stocks continued a two-day slide Thursday on weak economic data and concern about the Federal Reserve's resolve to keep juicing the economy.

Signaling that the U.S. labor market remains in slow recovery mode, the government said more people applied for unemployment benefits last week. The four-week average, a less volatile measure, rose to the highest in six weeks.

The Dow Jones industrial average closed down 46.92 points, or 0.3 percent, at 13,880.62.

The S&P 500 index dropped 9.53, or 0.6 percent, to 1,502.42. The S&P is headed for its first weekly loss of the year. The Nasdaq composite index lost 32.92, or 1 percent, to 3,131.49.

In Europe, markets closed sharply lower after a monthly survey of European executives showed that business activity in the European Union slowed in February, a strong signal that a downturn that began last year will continue into 2013. Benchmark indexes lost 2.3 percent in France, 1.9 percent in Germany, and 1.6 percent in Britain.

U.S. indexes have soared this year to the highest levels since the financial crisis but may be ready to fall back to earth, said Kim Caughey Forrest, senior analyst with Fort Pitt Capital Group, a portfolio management firm in Pittsburgh.

"I think the market has gotten ahead of itself," she said. She said fourth-quarter earnings have generally met expectations, but only after those expectations were reduced because companies made dire projections in November and December.

Wal-Mart Stores rose after beating analysts' profit forecasts in the fourth quarter. However, the biggest retailer warned of a slow start to the year. It gained $1.05, or 1.5 percent, to $70.26.

After a strong start to the holiday season, Wal-Mart said, the first three weeks of December were weak, and business has been volatile since then. The company attributed some of the weakness to a delay in tax refund checks that have left people strapped for cash. Wal-Mart's customers also have less money to spend because a temporary payroll tax cut expired in December.

"Everybody's gotten a 2 percent pay cut, and people who file their taxes early are not getting a refund back in a timely manner," Forrest said.

Supermarket chain Safeway was the biggest gainer in the S&P 500, rising $2.84, or 14.1 percent, to $22.97 after saying its net income jumped 13 percent in the fourth quarter, helped by higher gift and prepaid card revenue.

Electric car company Tesla Motors plunged a day after reporting that its fourth-quarter net loss grew 10 percent on costs related to production of its new Model S. The stock fell $3.38, or 8.8 percent, to $35.16.

Earlier, Asian stocks had closed sharply lower. The sell-off began Wednesday afternoon in New York after the release of minutes from the Fed's latest meeting. The meeting notes showed that some policymakers want to wind down bond purchases and other measures aimed at boosting the economy.

The minutes revealed new divisions over the Fed's low-interest rate policies. There is no sign of inflation, yet there was more evidence that some Fed officials are ready to ease off the stimulus programs before the economy has fully recovered.

The Fed's bond-buying has been boosting markets by reducing the cost of borrowing for companies and investors, Forrest explained. When interest rates are lower, it's possible to do business cheaper even if a company isn't growing, she said.

"Thinking maybe interest rates will creep higher, this is a very chilling scenario" for the market, she said.

The yield on the 10-year Treasury note fell to 1.98 percent from 2.05 percent early Wednesday as demand increased for ultra-safe assets.

Woman, 104, forced to lie about age on Facebook

(AP) ? Facebook is apologizing for a problem that makes a 104-year-old Michigan woman lie about her age on the social media website.

Marguerite Joseph's granddaughter says Facebook won't let Joseph list her real age.

Gail Marlow says when she tries inputting her grandmother's birth year as 1908, Facebook changes it to 1928. So for the past two years, the Grosse Pointe Shores centenarian has remained 99 ? online, anyway.

Joseph is legally blind and can't hear well, but Marlow reads and responds to all her Facebook messages.

Marlow tells WDIV-TV (http://bit.ly/Y7HQM2 ) she'd "love to see" Joseph's real age posted and chalks it up to "a glitch in the system."

Facebook spokesman Andrew Noyes told The Associated Press on Wednesday that it's working to fix a problem limiting used of pre-1910 birthdates.

Sony unveils its next game console, the PlayStation 4, arriving in holiday 2013

Sony tonight announced its much-rumored next video game console, the PlayStation 4. Sony Computer Entertainment prez and CEO Andrew House announced the console with little more than a logo and a handful of concepts, though he did say it's coming in holiday 2013. We're sure to hear more as the night goes on, and we'll be updating this post as we learn more.

Lead system architect Mark Cerny -- legendary game dev and, to us, creator of Marble Madness -- came up next. He said that development of the PS4 started five years ago. Cerny said he's been exploring how to evolve "the PlayStation ecosystem," and he started by speaking to the limitations of PlayStation 3. Cerny said he's been aiming to make sure "nothing gets between the platform and the game." An image of an old-timey hunter shooting space invaders in the sky is used as an example -- here's hoping the PS4 doesn't mean we'll be taking plastic guns and shooting pixels in the sky.

"We were able to create in PlayStation 4 a system by game creators, for game creators," Cerny said. As far as specs, he said it runs on x86 architecture, a "highly enhanced" PC GPU (with "almost 2 teraflops of performance," he added), an unknown amount of local HDD storage, and 8GB of GDDR5 system memory. Cerny next unveiled the DualShock 4, which looks an awful lot like the leaks we saw recently -- it features a touchpad, a light bar, and what looks like rubberized grips. Otherwise, it looks an awful lot like a DualShock 3 with some new bells and whistles.

Kepler probe discovers smallest alien planet

The discovery of a strange new world about the size of Earth's moon has shattered the record for the smallest known alien planet, scientists say.

The newfound alien planet Kepler-37b is the first exoplanet discovered to be smaller than Mercury. It whips around its parent star?every 13 days and has a roasting surface temperature of about 800 degrees Fahrenheit (427 degrees Celsius), researchers said. It not a promising contender for life, they added.


Astronomers found Kepler-37b and two other, larger planets (called Kepler-37c and Kepler-37d) orbiting a star about 215 light-years from Earth using NASA's prolific Kepler space telescope. Finding such a small exoplanet with the Kepler spacecraft was a stretch, but some attributes of Kepler-37b's parent star made the discovery possible.

The star has few sunspots and is bright relative to its planet, making it easier for?the Kepler spacecraft to spot the telltale dimming that takes place when a planet passes in front of its star, which scientists call a transit. That method revealed not just the presence of Kepler-37b, but two siblings traveling in orbits farther from the parent star. [Gallery: The?Smallest Alien Planets]

"There are not many signals masking the transit," study leader Thomas Barclay of NASA's Ames Research Center in Moffett Field, Calif., told Space.com. "What makes this exceptional was [that] this dip of brightness was just 22 parts per million."

Too hot to host life
Kepler-37b and its siblings, 37c and 37d, are probably uninhabitable, scientists said. All three planets lie close to their parent star, well inside the Earth-sun distance (called astronomical units, or AU). One astronomical unit is about 93 million miles (150 million kilometers).

The moon-sized Kepler-37b is so close to its parent star, at just 0.10 AU, that it probably has no atmosphere or liquid water on its surface. The next planet out, Kepler-37c, is slightly smaller than Earth and may have an atmosphere, but it orbits the star at 0.14 AU ? a location that's not in the star's habitable zone, where liquid water could exist on the surface.

The biggest planet in the newfound alien solar system is Kepler-37d. It is about twice the size of Earth and orbits the parent star at a distance of 0.2 AU.

"This could hold an atmosphere, but it's unlikely to be a rocky planet ? more likely to be gassy ? simply because of its size. It could hold some kind of liquid at the surface," Barclay said.

The next step, Barclay added, will be to look for Mercury-sized exoplanets at greater distances from the host star Kepler-37. More planets could be orbiting the star and await discovery.

"We're looking at it very carefully," Barclay said. "There's nothing yet, but something may appear in the data."

Starlight tells the tale
Barclay and his team took great care to confirm the existence of planets around Kepler-37. The researchers knew that a dip in the star's brightness identified by the Kepler spacecraft could have come from several types of sources, including another star that might be passing in front of the Kepler-37 target. So they ran a computer simulation to see if the newfound planet candidates could be false positives.

Using a tool called Blender from the Harvard-Smithsonian Center for Astrophysics, the researchers simulated several false positive scenarios in order to eliminate them. The results made researchers more than 99 percent confident that the planet candidates are actual planets, Barclay said.

The science team managed to obtain a close approximation of the size of the Kepler-37 star, in addition to spotting its planetary retinue. The star's quiescent nature allowed the researchers to measure it with asteroseismology, a technique that uses acoustic oscillations on the star's surface. The method is similar to how researchers probe the Earth's interior with seismic devices during earthquakes.

The uncertainty for a star's size is typically 20 to 30 percent, Barclay said. In this case, using asteroseismology, the researchers narrowed the uncertainty to 3 percent.

Measurements showed that Kepler-37 is about 75 percent the size of Earth's sun and 80 percent as massive. This places the star within the same stellar class as our sun.

The $600 million Kepler mission launched in March 2009, and has found more than 2,740 candidate planets so far. The spacecraft searches for small dips in stars' light caused by orbiting worlds that pass in front of them periodically, dimming their brightness.

Bringing New England to Southlake is Daddy Jack?s, which took over the space previously occupied by Cactus Flower Caf?. Well known for its red checker tablecloths and authentic New England-style seafood, locals have lined up for the lobster rolls, thick clam chowder and fresh seafood. Originally from Nova Scotia, founder ?Daddy Jack? Chaplin also owns Chaplin?s in New London, Connecticut. With two other locations in Dallas and Sundance Square, it appears Texans approve of the ?northern? menu, as validated by numerous accolades and awards. Daddy?s Jack?s is open daily for lunch and dinner.

Trust STFC chief wants football 'prenup'

FOOTBALLING prenups should be considered by the authorities in a bid to avoid a repeat of recent events at Swindon Town.

That is the opinion of Trust STFC chairman John Ward, who has called for the Football League to look into the possibility of making rich benefactors agree to their exit strategy before buying into a club.

Ward?s idea, which echoes the special arrangements made in law between a husband and wife prior to marriage which divide their estate in the event of a divorce, comes after Town?s former majority shareholder, Andrew Black, decided to withdraw his funding in Wiltshire - leaving the club with a frantic search for new owners.

Swindon?s future was secured by the arrival of Jed McCrory?s consortium, but Ward is anxious that clubs are not threatened with such precarious positions again.

?The whole Andrew Black episode made me go overboard in saying the generous benefactor model clearly doesn?t work. I think it could work,? he said.

?Let?s say that the new consortium comes out of the assessments of the Football League with flying colours, what is going to stop it from one or more of them getting cold feet two, three, four years down the line.

?It?s their money, it?s not somebody else?s, and they?re entitled to do what they like with it. What I think needs to be put in place, and it?s very difficult, is some sort of exit strategy so that somebody can?t decide as a big investor overnight that he?s bored with it.

?Of course they?re entitled to take that view, but there ought to be some way this can be phased - perhaps having to give notice. Then there?s the case of what sort of notice. Well, since footballers? wages are the biggest item maybe it?s related to outstanding contracts of players so they can?t leave the club in the lurch but they can get out.

?A set-up like that is very difficult and it won?t be easy to get some sort of legal framework or even something in writing but I think it should be at least thrown into the debate of how we can avoid not just us but other clubs seeing the same sort of thing happening.

?They can be well intentioned consortia of total integrity who then after a bit isn?t willing to continue. How do we address that? Some sort of exit strategy, which is agreed on all sides, needs to be something where the Football League as a regulatory body makes clubs do this.

?I think expecting individual clubs to do it on their own, given the pressures, would be very difficult. Adopting this approach to the benefactor model would be something well worth exploring.

?It shouldn?t happen to Swindon again and it shouldn?t happen to other clubs again.?

Hugh Grant reveals birth of son on Twitter

Actor Hugh Grant has become a father for the second time and announced the news on his Twitter account - but warned the press to leave his family ?in peace?.

The Notting Hill and Bridget Jones star is ?thrilled? to have welcomed a baby boy, a brother for his one-year-old daughter Tabitha, with Chinese actress Tinglan Hong - a relationship that started out as a ?fleeting affair?.

The 52-year-old film star has almost been more famous for his appearance at the Leveson Inquiry and his campaigning for a more responsible press of late than for his films, and his tweets are not without a reference to that passion.

He tweeted: ?In answer to some journos. Am thrilled my daughter now has a brother. Adore them both to an uncool degree. They have a fab mum.

?And to be crystal clear. I am the Daddy.

?Thanks for v kind messages. Now I've confirmed (press somehow got birth certificate & were calling),hoping my family will be left in peace.?

When Tabitha was born in 2011, Grant's publicist released a statement revealing the nature of his relationship with Ms Hong: ?I can confirm that Hugh Grant is the delighted father of a baby girl.

?He and the mother had a fleeting affair and, while this was not planned, Hugh could not be happier or more supportive.

?He and the mother have discussed everything and are on very friendly terms.?

Grant has had relationships with high-profile figures in the past - most notably actress Elizabeth Hurley and socialite Jemima Khan.

He managed to move on from the scandal that engulfed him following his well-publicised encounter with a Hollywood prostitute in 1995.

His previous film credits include About A Boy, Love Actually and Four Weddings And A Funeral.

New Mexico Might See More Taxis

A legislative committee heard mostly positive testimony yesterday concerning a bill that would update regulations and increase competition for taxis, shuttles, moving companies, and other motor carriers. The sponsors will address some concerns and bring the bill back on Tuesday.

The House Business & Industry Committee discussed a substitute for House Bill 194, introduced by state Rep. Tom Taylor, R-San Juan, and state Rep. Carl Trujillo, D-Santa Fe. Think New Mexico, a non-profit, sought this reform and drafted the bill.

Current state law requires anyone wanting to start a taxi, shuttle, tour bus, limo, or moving business to apply at the Public Regulation Commission for a certificate. These entrepreneurs must also notify their competitors, who can then protest the application.

To get approval for their business, these entrepreneurs have to hire an attorney and prove that existing companies have not fully served the market. The PRC must deny these applications if current companies show they would lose business to competitors.

HB 194 would shift the burden of proof. ?Full-service? taxi and shuttle companies could protest applications from potential competitors. But existing companies would have to show competitors would harm the level of motor carrier service available to the community.

Full-service motor carriers include businesses that schedule customer pickups over the phone, centrally dispatch taxis at any hour of day or night, or regularly send shuttles to and from an airport.

The bill would also reduce barriers to entry. The PRC would issue certificates to new cab, limo, shuttle, and tour bus companies that had insurance. Tighter regulations would remain in force for ambulances, tow trucks, and competition with full-service firms.

A representative from the Public Safety Department explained New Mexico could lose $4 million in federal funding. The bill would protect those funds by updating state law. Federal regulations require motor carriers to insure their largest vehicles for $5 million.

Motor carrier operators could change what they charge customers without obtaining PRC approval. Rate changes would take effect immediately, unless they exceeded PRC maximums. Moving companies could no longer charge common rates and full-service firms could still protest competitor rates.

Over a dozen groups and individuals spoke in favor of the bill. Trujillo said Think New Mexico met with various stakeholders and secured about 90% agreement. Raymond Sanchez, a registered lobbyist for two Albuquerque cab companies, mostly criticized the bill.

Sanchez objected to amnesty provisions. The PRC should penalize cab companies if they start operating before receiving a certificate, he said. The bill makes an allowance for new businesses that did not realize they needed a license from the PRC.

A staff attorney from the PRC assured the committee that the PRC investigates every complaint it receives.

Two years ago Green Cab applied for a certificate from the PRC to operate in Albuquerque. The two cab companies in Albuquerque protested this application and Green Cab incurred $90,000 in attorney fees.

In July 2011, PRC staff responded to the Albuquerque cab companies. They wrote ?the Albuquerque Cabs appear to operate as a cartel,? ?they charge identical rates,? and ?their interests may be best served by maintaining rates above the market rate.?

By comparison, Yellow Cab of Denver costs $2.50 up front and then $2.25 per mile. AAA Yellow Cab Company of Phoenix charges $2.50 to start and $2.00/mile. A five-mile trip would cost $13.75 in Denver and $12.50 in Phoenix.

Currently, ABQ Cab Company customers pay $2.50 and then $2.20 per mile. Yellow Cab Company of Albuquerque charges people $5.54 and $1.60 each mile. An individual traveling 5 miles would pay $13.50 to ABQ Cab and $13.54 to Yellow Cab.
